According to the SBV, the regulators have issued warnings about the risks associated with Bitcoin and virtual currencies, as well as using virtual currencies for crimes (such as money laundering , terrorismsponsorship, illegal money transfer, tax evasion, other frauds etc.) because virtual money is anonymous, scattered, unmanaged by any agencies or organizations.
The investment, trading, and capital mobilization through the Initial Coin Offering (ICO), especially in a multi-level mode is becoming more and more complicated and posing threats to the stability of the financial market and the social security and potentially hazardous to involved organizations and individuals.
In order to restrict the risks and consequences to the society, as well as promptly detect, prevent and handle
violations, the SBV prepared and proposed to the Prime Minister for the issuance of Directive No.10/CT-TTgdated April 11, 2018 on strengthening the management of the activities concerningBitcoin and similar virtual currencies.
Meanwhile, the SBV is assigned to instruct credit institutions and intermediary payment service providers not to carry out illegal transactions related to virtual currencies; to enhance the review and timely reporting of suspicious virtual money transactions as stipulated by the law. The Directive also requires these agencies to coordinate with the Ministry of Public Security in detecting and handling the illegal use of virtual currencies as means of payment.
In addition, the SBV issued Directive No. 02/CT-NHNN dated April 13, 2018 requesting departmentsat its head office, the provincial branches, credit institutions, intermediary payment service providersto seriously take measures to manage transactions and activities related to virtual currencies.
At the same time, the SBV has also taken the initiative in issuing documents to instruct credit institutions, foreign bank branches, payment intermediaries and other related units to implement measures and enhance the management of transactions and activities related to virtual currencies.< o:p>
In discussion with the Ministry of Justice to improve the legal framework for managing virtual currencies in Vietnam, the SBV indicated that Bitcoin and other similar currencies are not recognized as legal currencies and means of payment in Vietnam.< /o:p>
