In contributing to the amendment of the Law on Deposit Insurance, DIV has actively coordinated with SBV's relevant units to conduct a comprehensive review of the implementation of the current Law, to study and propose revised policy content, and to provide comments on the draft proposal dossier. From 2022 to 2024, DIV submitted 16 official documents to the SBV, offering feedback, updating data, and proposing revisions to the Law. Each proposal included detailed justifications, impact assessments, and references to international practices. Furthermore, during working sessions and technical meetings convened by SBV, DIV reported specific implementation challenges, presented the rationale for each proposed revision, and clarified differences in viewpoints between relevant stakeholders.
Given that this is a specialized legislative framework with significant implications for DIV's institutional structure and operations—as well as for related stakeholders such as insured institutions and depositors—this legislative process necessitates a concerted mobilization of DIV’s internal resources across multiple dimensions:
Human Resources
Pursuant to the SBV’s requirement, DIV has designated personnel to participate in the internal Drafting Committee and the supporting Task Force responsible for developing the revised Law on Deposit Insurance. On November 14, 2024, the Governor of the SBV issued Decision No.2507/QĐ-NHNN, establishing the internal Drafting Committee and supporting Task Force.
In parallel, DIV established its own internal Drafting Committee and supporting Task Force to coordinate the legislative process. Members are assigned responsibilities in line with their respective mandates and are expected to undertake legal reviews and contribute substantively to the drafting of the revised Law. Technical departments are tasked with conducting in-depth research and policy proposals within their operational scope to ensure that proposed revisions are comprehensive, evidence-based, and of high quality.
In the context of the national objective of enhancing the quality of personnel engaged in legal policy development—as articulated under the Prime Minister’s Decision No.916/QĐ-TTg dated August 27, 2024, approving the Project on “Developing Human Resources for Legal Policy Advisory Work Toward 2030” - DIV has been actively developing internal human capital through improvements in recruitment, labor and salary welfares, and training systems. Special emphasis has been placed on the training of legal and policy experts involved in the legislative process.
Financial Resources
DIV recognizes the necessity of ensuring adequate financial resources to support research, review, drafting, and consultation activities associated with the law-making process. Budgetary provisions are being made to incentivize and support staff participating in legislative research and drafting activities. Other relevant expenses associated with the legislative process have also been anticipated and budgeted to ensure seamless implementation.
Information Resources
To substantiate its proposed amendments, DIV has emphasized the collection and analysis of relevant data to support policy impact assessments and legal reasoning. Additionally, DIV actively engages in benchmarking and knowledge exchange with peer institutions in jurisdictions with well-established deposit insurance systems to draw on comparative international experience.
To enhance the quality of its legal opinions, DIV also consults with legal, financial, banking, and insurance experts, insured institutions, and the general public through targeted surveys on deposit insurance policies.
Technological Resources
The legislative process also requires strong support from information technology systems. DIV has invested in essential infrastructure, including computer systems, internet connectivity, email platforms, and document management software to facilitate effective drafting and collaboration.
Currently, DIV is continuing its review and refinement of policy proposals, working closely with the SBV and its affiliated units to finalize contributions to the proposal dossier. Looking ahead, DIV must intensify its efforts by reviewing all legal content related to deposit insurance and the institutional role of the deposit insurer as prescribed under the Law on Credit Institutions (2024). Simultaneously, DIV continues to assess practical challenges in the implementation of the current Law in order to provide well-founded input throughout the legislative process as required by the SBV.
Internal units at DIV are expected to prepare comprehensive policy rationales and conduct in-depth research to formulate more precise and actionable proposals for the amendment of the Law. These efforts aim to strengthen the legal foundation for protecting depositors’ legitimate rights and interests, enhancing the effectiveness of the deposit insurance system, contributing to the stability of the credit institution system, and promoting the sound and sustainable development of the banking sector.
